The WTO Dispute Settlement

Marc L. Busch, Eric Reinhardt
The trade brief analyses how the WTO dispute settlement works and the three stages for a dispute (consultation, formal litigation and implementation). The prospective benefits and hurdles to effectively use the system by developing countries is also discussed. Some poorer countries have used the system to great effect, proving the system's worth from a development perspective. nonetheless, the technical and legal complexity of this regime makes it difficult for other developing countries to effectively use the system. Finally, some potential directions for technical assistance and capacity-building are given.
